These Terms and Conditions are applicable to the relationship between Perks Loyalty Ltd (trading as Brandstack) and the Customer who subscribed to the Loyalty Program.

1. Definitions

Action: An action taken by a Customer in their relationship with Perks Loyalty Ltd (trading as Brandstack).

Customer: a natural person or legal entity who does business with Perks Loyalty Ltd (trading as Brandstack).

Cashback: value that can be awarded by Perks Loyalty Ltd (trading as Brandstack) to a Member, which can be withdrawn to a UK bank account.

Loyalty Program: award program in which Perks Loyalty Ltd (trading as Brandstack) can award cashback to Members for specific Actions.

Member: a Customer who subscribed to the Loyalty Program.

Terms and Conditions: these terms and conditions in respect of the Loyalty Program of Perks Loyalty Ltd (trading as Brandstack), as amended from time to time.

3. Applicability

  1. The Loyalty Program is available to Customers for their personal use only and is limited to one account per Customer. Attempts by a single Customer to open multiple accounts may result in suspension of all their accounts.
  1. To subscribe to the Loyalty Program, a Customer is required to register an account on the Brandstack mobile app with a valid email address. By registering an account, a Customer agrees that these Terms and Conditions will apply to the relationship between Perks Loyalty Ltd (trading as Brandstack) and the Customer subscribed to the Loyalty Program.
  1. Perks Loyalty Ltd (trading as Brandstack) may refuse at its sole discretion the subscription of a Customer in the Loyalty Program.
  1. Use of the Loyalty Program is limited to users who are at least 18 years old, although if you are 13 or more, but not yet 18, you may use this website if your parent or legal guardian agrees to these Terms and Conditions on your behalf. Use of the Loyalty Program is not directed to users under the age of 13. If you are under the age of 13, you are not permitted to use the Loyalty Program , register as a Member or send personal information to Perks Loyalty Ltd (trading as Brandstack).

4. Cashback

  1. To earn cashback, a Customer needs to register an account on Brandstack mobile app. Upon valid subscription, the Customer becomes a Member.
  1. Members will receive the specified amount of cashback highlighted in an offer presented in the app upon satisfactory completion of the requirements of each offer.
  1. The total up-to-date amount of cashback awarded is visible on a Member’s Loyalty Program account after a maximum of 24 hours from the time the last Action was conducted.
  1. Cashback is not transferable to other accounts of Members or otherwise.
  1. Cashback earned by a Member are valid until the Loyalty Program is terminated.
  1. Members are required to report any inaccuracy in their awarded cashback to Perks Loyalty Ltd (trading as Brandstack)’s customer service within one month from discovering such inaccuracy.
  1. Perks Loyalty Ltd (trading as Brandstack) has the right to correct any wrongfully awarded cashback.

5. Duration, modification and termination of the Loyalty Program

  1. Perks Loyalty Ltd (trading as Brandstack) can alter these Terms and Conditions, any aspect of the Loyalty Program including redemption procedures and rewards in any respect, all without prior notice. For example, but without limitation, we may add, delete or change partners, suppliers, time, limits for collection, redemption or use of cashback. Perks Loyalty Ltd (trading as Brandstack) will publish the amended Terms and Conditions on the Brandstack website (brandstack.co.uk).
  1. A Member who continues participation in the Loyalty Program constitutes his/ her acceptance of any changes to these Terms and Conditions.
  1. A Member can choose to leave the Loyalty Program at any time. Members leave the Loyalty Program by contacting Perks Loyalty Ltd (trading as Brandstack) who will arrange for the Members account to be deleted. By leaving the Loyalty Program, a Member terminates the relationship with Perks Loyalty Ltd (trading as Brandstack) with respect to the Loyalty Program and forfeits the right to any cashback accrued.
  1. Perks Loyalty Ltd (trading as Brandstack) reserves the right to cancel the Loyalty Program at any time without prior notice. 
  1. Perks Loyalty Ltd (trading as Brandstack) reserves the right to cancel or suspend a Member’s account in case of (suspected) violation of these Terms and Conditions.

6. Receipt and Invoice Uploads

  1. Receipt or invoice images submitted to the Loyalty Program must legibly include the retailer name, all individual items purchased and their prices, the total amount paid and transaction date. If any of this receipt information is illegible or missing, your receipt may not earn cashback.
  1. Receipt or invoice images must be submitted within 14-days of the in-store transaction to be eligible for cashback. The same receipt or invoice may not be uploaded more than once. You may only submit real, unmodified receipts or invoices for transactions that you were part of.
  2. Cashback will only be awarded for receipts or invoices from major UK wholesaler chains. Perks Loyalty Ltd (trading as Brandstack) reserves the right to reject receipts/invoices if the authenticity or source of the receipt/ invoice is unable to be verified.
  1. If it is not possible to automatically authorise or reject a receipt or invoice image submission, it will be manually reviewed and a decision provided to the customer within 72 hours of submission.
  2. Members may submit a maximum of 5 receipts or invoices per day.

7. Data and Privacy

  1. While registering to become a Member of the Loyalty Program, you will be asked to provide certain personal information. In accordance with the requirements of the relevant data protection and privacy legislation (Data Protection Act and the GDPR)  we will take all reasonable steps to ensure that your personal data is kept secure against unauthorised access, loss, disclosure or destruction.
  1. Perks Loyalty Ltd (trading as Brandstack) privacy policy will apply whenever you provide us with personal information. We may also send you relevant messages about our products and offers including those from our approved partners only.

8. Other

  1. Perks Loyalty Ltd (trading as Brandstack) shall not be held liable for any default resulting directly or indirectly from any cause beyond our control, including but not limited to, failure of network services and failure of data processing systems.
  1. For complaints about the Loyalty Program, please contact Perks Loyalty Ltd (trading as Brandstack).
  1. The law of England and Wales applies to these Terms and Conditions. Any disputes between Perks Loyalty Ltd (trading as Brandstack) and the Member relating to the Loyalty Program and/ or these Terms and Conditions, can only be submitted to the relevant competent court, both by Perks Loyalty Ltd (trading as Brandstack) and the Member.
